Intense Retail will never sell your information to third parties.

Intense Retail is a recruitment and consultancy business, which provides work-finding and brand consultancy services to its clients and work-seekers. The Company must process personal data (including sensitive personal data) so that it can provide these services – in doing so, the Company acts as a data controller.

 

You may give your personal details to the Company directly, such as on an application or registration form or via our website, or we may collect them from another source such as a jobs board, Linked In or a website. The Company must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you, or for the purposes of providing brand consultancy services, we will only use your personal data in accordance with the terms of the following statement.

The Company has collected your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. The legal bases we rely upon to offer these services to you are:

  • Legal obligation

The lawfulness of conditions for are:

  2. Processing is necessary for the performance of a contract with the individual or in order to take steps at the request of the individual to enter into a contract.

  5. Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller.

Processing is necessary for the purposes of legitimate interests pursued by the controller or a third party, except where such interests are overridden by the interests or fundamental rights or freedoms of the individual which require protection of personal data, in particular where the individual is a child.

 

The lawfulness of conditions for are:

  1. Explicit consent of the individual for one or more specified purposes, unless reliance on consent is prohibited by EU or Member State law.

  2. Processing is necessary for carrying out data controller’s obligations under employment, social security or social protection law, or a collective agreement, providing for appropriate safeguards for the fundamental rights and interests of the individual.

  3. Processing is necessary to protect the vital interests of the individual or another individual where the individual is physically or legally incapable of giving consent.

  4. In the course of its legitimate activities, processing is carried out with appropriate safeguards by a foundation, association or any other not-for-profit body, with a political, philosophical, religious or trade union aim and on condition that the processing relates only to members or former members (or those who have regular contact with it in connection with those purposes) and provided there is no disclosure to a third party without the consent of the individual.

  5. Processing relates to personal data which are manifestly made public by the individual.

  6. Processing is necessary for the establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity.

  7. Processing is necessary for reasons of substantial public interest on the basis of EU or Member State law which shall be proportionate to the aim pursued, respects the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and interests of the individual.

  8. Processing is necessary for the purposes of preventative or occupational medicine, for assessing the working capacity of the employee, medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems and services on the basis of EU or Member State law or a contract with a health professional and subject to the necessary conditions and safeguards.

  9. Processing is necessary for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of healthcare and of medicinal products or medical devices, on the basis of EU or Member State law which provides for suitable and specific measures to safeguard the rights and freedoms of the individual, in particular professional secrecy.

  10. Processing is necessary for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard fundamental rights and interests of the individual.

b. Legitimate interest

 

Where the Company has relied on a legitimate interest to process your personal data our legitimate interests is/are as follows:

 

  • If you have been involved with a recruitment process with Intense Retail it may be necessary for us to retain data in relation to this, which does not impact your rights.

  • We may use your address details to send you direct marketing information by email or post, to advise about our services or a specific career opportunity that we think might interest you.

  • In the case of brand consultancy services we may use your contact details to send you surveys or direct marketing information by mail or post to advise you about our services or a store location opportunity that we think may interest you.

 

c. Recipient and how we protect your personal data

 

We understand data security is important to you and all information received is kept securely on our database via up to date technology, protected by a password. Access is limited to employees of Intense Retail and vetted third parties.

Your Candidate Information will be shared with third parties as follows:

  • Your Candidate Information will be stored in databases located in the United Kingdom, India and The Philippines.

  • Via the databases, your Candidate Information will be available to the consultants and administrative staff of the different companies in the Intense Retail Network for the purposes of providing the Client Services;

  • In this context, please be aware that various companies of the Intense Retail Network, most of the third-party service providers operating the database servers and some of our clients we might disclose excerpts of your Candidate Information to are located in countries outside of the European Economic Area (EEA) that have not been found by the European Union to provide an adequate level of protection of personal data, i.e. a level of protection of fundamental rights and freedoms that is essentially equivalent to that guaranteed within the European Union. Similarly, the countries your Candidate Information, or parts thereof, might be transferred to in accordance with the above may not be found to provide an adequate level of protection by jurisdictions outside of the European Union.

d. Statutory/contractual requirement

 

Your personal data is not required as part of a statutory and/or contractual requirement, and/or a requirement necessary to enter into a contract.

 

    2. The Information we require to assist you in your job finding services and brand consultancy services.

 

The Company has collected the following personal data on you:

  • Name

  • Most recent position (job title)

  • Contact information which will include email address, telephone number place of residence with postal code.

  • Copies of documents you provide for the purpose of identity, such as a passport or driver’s licence.

  • If a passport, this will include details of your full name, address, date of birth, gender and nationality.

  • Information provided by you in connection with a specific recruitment project, such as career history and salary requirements.

Sensitive personal data:

  • Disability/criminal conviction

 

    3. What do we do with the information we receive?

 

This information is used in the recruitment process either in the case of a client company for the purpose of sourcing potential candidates or to support you as a candidate in your career search.

 

  • If you have been involved with a recruitment process with Intense Retail it may be necessary for us to retain data in relation to this, which does not impact your rights.

  • We may use your address details to send you direct marketing information by email or post, to advise about our brand consultancy services or a specific career opportunity that we think might interest you.

  • In the case of brand consultancy services we may use your address details to send you surveys or direct marketing information by mail or post to advise you about our services or a store location opportunity that we think may interest you.

  • We will do this on the basis of our legitimate interest or for communication required by law.

  • You are free to opt out of receiving information from us at any time and can do so by  emailing us at anna.jones@intenseretail.com and quoting ‘unsubscribe ‘ in the subject.

 

 

    4. How long do we keep your data for?

 

The Company will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

 

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.

 

If there has not been contact within 24 months, Intense Retail will request an update. The nature of recruitment is such that it is common to keep up to date and in contact over a number of years and throughout a career for a candidate.

 

We can update and retain your personal details with your consent until you wish to delete your records from our database.

 

    5. What are your rights over the personal data we hold?

Please be aware that you have the following data protection rights:

 

  • The right to be informed about the personal data the Company processes on you;

  • The right of access to the personal data the Company processes on you;

  • The right to rectification of your personal data;

  • The right to erasure of your personal data in certain circumstances;

  • The right to restrict processing of your personal data;

  • The right to data portability in certain circumstances;

  • The right to object to the processing of your personal data that was based on a public or legitimate interest;

  • The right not to be subjected to automated decision making and profiling; and

  • The right to withdraw consent at any time.

    6. From where do we source personal data?

The Company sourced your personal data/sensitive personal data by the following means:

 

  • Through our website

  • Through other websites which we use for marketing purposes

  • When you engage with us via social media or business media sites

  • When you contact us directly through a recommendation or through another source

  • Or this information came from a publicly available source

By providing this information to us you are consenting to your personal data being collected and stored. We will acknowledge receipt and ask you to reconfirm that you wish to be on our database for the purpose of recruitment search, a personal career search or information about brand consultancy services.
